A Number of New National Standards, Laws and Regulations to Come into Force in 2014

In accordance with the approval of Standardization Administration of China and relevant departments of the State, a number of latest national standards, laws and regulations will come into effect in 2014 as planned. These new regulations would have positive impact on quality improvement of product and service and industry development of all walks of life.


“Special Equipment Safety Law of the People’s Republic of China” will be put into implementation on Jun. 1st, 2014.


“Special Equipment Safety Law of the People"s Republic of China”, as adopted at the 3rd session of the Standing Committee of the Twelfth National People"s Congress of the People"s Republic of China on June 29, 2013, and announced by Order No. 4 of the President of the People’s Republic of China, will come into force on January 1, 2014.

Special Equipment include boilers, pressure vessels, pressure pipelines, elevators, lifting appliances, passenger ropeways, large-scale amusement devices, etc. In recent years, special equipment safety-related accidents frequently happened, as the first relevant law, the law provides important legal support for responding the problem of security monitoring resulted from sharp rise in the number of special equipment such as elevator, and ensuring the security and safety in using special equipment.

The law establishes the responsibility division of production unit, sales unit and use unit of special equipment, clearly highlights the corporate responsibility, sets up the traceability system , the recall system and scrapping system of special equipment, increases the penalties for illegal activities,reflects the priority principle of civil compensation, puts people first, benefits for protecting the personal and property interests of the public.


The newly revised” Law of the PRC on Protection of the Rights and Interests of Consumers” will be put into implementation on Mar. 15th, 2014.


The newly revised “Law of the PRC on the Protection of the Rights and Interests of Consumers”, as adopted at the 5th session of the Standing Committee of the Twelfth National People"s Congress of the People"s Republic of China, will come into force on Mar. 15th, 2014.

In recent years, with the rising of online shopping and changing of public consumption pattern, structure and concept, the new law had been through 3 stringent reviews. It improves the social honesty construction, fully refines the rights and interests of consumers, strengthens the obligation of proprietor, makes specific provision for new consumption pattern especially for online shopping, also improves and complements the responsibility of network trading platform.

The new law stipulates that consumers have the right to regret, they can return the goods (except some specified commodity) without any reason within 7 days from the date of receipt, which ensures autonomous right of consumers; operator shall protect consumers’ personal information, shall not serve advertisement without permission, which ensures information security of consumers; advertising agents shall undertake joint liability for false advertisements and consequences of violations; consumers’ association shall not merchandise passingly; if there is any fraud in providing commodity or service, operator shall triple the compensation for losses, and the contents of compensation include mental damage compensation; operator shall bear the burden of proof, and the license may be revoked if there is any production date tampering. All these rules can ensure maximum protection for consumers’ legitimate rights and interests.


“General Hygienic Specifications for Food Production” will be put into implementation in June


Instead of “General hygienic regulation for food enterprises”, the newly revised national standard for food safety “General Hygienic Specifications for Food Production”, which was revised by National Health and Family Planning Commission of the People’s Republic of China, will come into force in June.

“General Hygienic Specifications for Food Production” is the most basic condition and hygiene requirements for food production. The standard sticks to the "prevention, scientific supervision" principle, fully references the international practice for food safety, scientifically analyses food safety risks that may exist in food production, specifies the “Food Safety Law” and its implementing regulations on food production process management requirements, is the technical basis for the implementation of the whole process of food safety regulation.

Revision of the standard emphasizes on food safety control requirements of the whole process, such as raw materials, processing, storage, transportation, etc., and develops measures to control the major biological, chemical and physical contamination; modifies production equipment related content, makes demands on layout of production equipment, material and design from the perspective of preventing biology, chemistry, physics pollution; increases raw material procurement, inspection, transportation and storage requirement; increases specific requirements of product traceability and recall; increases the records and documents management requirements. This will have major effects on ensuring food hygiene and promoting food safety production from the source.
